Premium Processing Filing Fee Increased

On October 19, USCIS increased its filing fee for the I-907, Request for Premium Processing Service. In an associated news release, USCIS stated that the premium processing filing fee will be increased from $1,440 to $2,500 for all filings, except H-2B and R-1 filings where the premium processing filing fee will be increased from $1,440 to $1,500.

The law responsible for the increased premium processing filing fees, the Continuing Appropriations Act, 2021 and Other Extensions Act, Pub. L. No. 116-159, went into effect on October 1 and requires USCIS to “establish and collect additional premium processing fees and use the additional funds for expanded purposes.” More specifically, the law gives USCIS the ability to premium process additional forms and benefit requests. USCIS has not yet clarified how it intends to expand the premium processing service.

Our law office will continue to monitor the situation and alert our clients of important news.
